What's different in regulated mode

Every draft passes through the standard Editor compliance gate plus a second LLM-driven legal review tuned to your regulator. Nothing publishes until a person on your account approves it in your approval queue — regulated accounts never get auto-approve.

Two-layer compliance review. Every paragraph rewrite, FAQ entry, blog post, and review response runs through Editor's regular compliance gate plus a second legal-review pass with regulator-specific phrasing rules (FINRA / SEC for finance, HIPAA for healthcare, ABA / state-bar for legal, etc.).
Seven-year audit retention. Every change, every approval, every draft — snapshotted and retained for seven years per FINRA Rule 4511 / SEC 17a-4 / HIPAA equivalents. Exportable to your existing recordkeeping system on request.
Never auto-approved. Every draft waits in your approval queue until a person on your account approves it — your compliance officer, or whoever you give access to. Auto-approve is off for regulated accounts and cannot be turned on.
Regulator-matched disclaimers. Editor appends a disclaimer suited to the regulator you name at signup to the bottom of every published page — blog posts, FAQ, At-a-Glance, rankings substitute. It arrives in your approval queue with the draft, so you read the exact wording in place and change it there before anything publishes.
We never restate your license number. Toutmark does not store your license number, license type or admitted jurisdictions, and never publishes them — we can’t verify them, and a credential we can’t stand behind has no business in your structured data or your page footers. Your own disclosures page stays the single source of truth; our pages link to it rather than repeating it, so there is never a second version of your standing to drift out of date.
Education page instead of rankings page. Regulated customers don't get our default "Top X tools 2026" comparison page (a regulatory minefield). Instead you get an industry-education page — definitional, not comparative. Same SEO + AI citation benefit, zero comparison liability.
FAQ category gating. Performance claims, AUM figures, fund-specific Q&A, solicitation-adjacent questions, testimonial-format Q&A, client-identifying Q&A — all blocked from auto-generation. Only allowed: firm identity, industry-education, general process. Reddit answer drafts and the AI-engine FAQ candidates are off for regulated profiles by default.
Off-menu-ask review responses queue automatically. If a G2, Capterra, or Google review asks for anything not currently offered on your site (refund, custom feature, scope expansion), the response waits in your approval queue for a person. On a regulated account every response does, whatever the review says.
Spokesperson attestation enforced. HARO requires an attested spokesperson on file before a journalist’s question can be routed to them. Your spokesperson writes the answer themselves, in their own words, so every quote attributed to them is one they wrote. Your firm runs its own compliance review of those words before your spokesperson presses Send or emails the journalist themselves; Toutmark never writes, edits, approves or sends anything your spokesperson has not sent.
No competitor comparisons. Hard rule across all content for regulated customers — we never name a competitor or imply outperformance. Category-level commentary only ("in this space, you tend to see X") with verifiable sources.
Excluded content types. Cold solicitation, performance claims not in your original source material, social posts on your account, comparative rankings — all blocked structurally. The system can't draft these for you even if you ask.

Compliance questions

Is your compliance review a substitute for our internal CCO?

No. Our compliance gates are an additional layer designed to surface obvious violations before a draft reaches your approval queue (banned phrases, performance claims, jurisdiction errors, comparison language). A person on your account still approves every draft before it publishes; nothing is auto-approved in regulated mode. We make their job easier, not redundant.

Which regulators do you specifically tune for?

FINRA, SEC, FTC §5 (universal), state bar associations, HIPAA / HITECH, state insurance commissioners, state real-estate licensing boards. The ruleset is configured per-customer based on your industry + jurisdictions at signup. We don't claim to be a regulator-of-record — we claim to filter content against the public phrasing rules each regulator publishes.

How does the off-menu-ask rule work for review responses?

When a review on G2, Capterra, or Google Business Profile asks the company for something — a refund, a custom feature, a scope expansion, anything not offered on your site — the response always queues for your approval. The agent drafts the reply (with the no-promises rule applied), and it waits in your approval queue for a person. On a regulated account every review response waits there too; there is no auto-publish in regulated mode.

What's your audit-retention format?

Every change is snapshotted with timestamps, actor (which agent or human), draft text before + after, approver identity, approval timestamp, and the regulator-specific compliance check that ran on it. Each row carries a prev_hash + this_hash (SHA-256 of the prior row hash + the JSON-serialized row content). A daily root hash is HMAC-signed with our audit secret and persisted alongside the row hashes. The chain is verifiable end-to-end: anyone with the daily root signatures and the rows can re-derive the chain and confirm nothing was tampered with after the fact. Exportable as CSV or JSON (with the full chain + signed roots) from your audit-log page at any time. Retained for 7 years per SEC 17a-4 / FINRA 4511 / HIPAA equivalents.

Can we get a copy of your compliance ruleset before signing up?

Yes — request our Regulated Mode Compliance Overview (~3,400 words). It documents the banned-phrase tables, blocked content categories, approval-gate matrix, required disclosures, and audit-log format we apply per regulator (FINRA, SEC Marketing Rule, ABA / state-bar, HIPAA, state insurance, state real estate, FTC §5). What if our regulator updates a rule?

A daily monitor cron polls FINRA Notices, SEC Marketing Rule guidance, FTC announcements, and HHS HIPAA guidance feeds. New notices are classified by Claude Sonnet for content-rule relevance and queued for our compliance review (target: 5 business days from publication; SLA tracked internally). Once we apply ruleset deltas, every affected customer’s dashboard surfaces a banner identifying the rule + the new gate, and an alert goes to the contact email on file. State bar advertising opinions are added per state as we onboard customers in each jurisdiction. Source feed list and monitor cron status are inspectable on request.
