Acceptable Use Policy

Legal Disclaimer: Toutmark is not your lawyer. This document is drafted pragmatically but has not been reviewed by counsel. Before onboarding enterprise customers or processing large volumes of EU/UK data, Toutmark will commission a legal review. Customers should consult their own counsel about whether these terms work for their use case.

This Acceptable Use Policy defines what you agree not to do when using Toutmark. Violation of this policy will result in account suspension and may result in permanent termination.

0a. Comparative Content Policy

You agree to comply with Toutmark's two-layer comparative-content policy:

Layer 1 — No Named Direct Competitors (all customers). You agree not to instruct Toutmark to draft, publish, or distribute content that names, identifies, ranks, criticizes, or makes comparative claims about your direct competitors. Toutmark's drafting policy hard-blocks named-competitor comparisons across all surfaces (HARO pitches, EIN releases, paragraph rewrites, Q&A and education pages, rankings pages, blog and social posts, llms.txt, schema). The rare opt-in path requires your attorney's pre-clearance + your personal verification + a per-claim Comparative Claim Authorization in your dashboard, and even then Toutmark's Editor may decline if substantiation is not ironclad.

Layer 2 — Tier-Aware Comparison Rule. If you are in a regulated industry (RIA/BD, healthcare, legal, insurance, finserv-non-securities, crypto, real estate, telehealth, MLM, tax/CPA), you agree that Toutmark will not include ANY comparisons in your AI-drafted content — including category-level, industry-baseline, customer-own-past-performance, or legacy-versus-modern framing. This is binding regardless of your preference; the regulated tier maps to your regulator's restrictions (SEC Marketing Rule 206(4)-1, FINRA Rule 2210, state medical board and FTC healthcare advertising rules, state bar attorney rules, etc.). If you are NOT in a regulated industry, Toutmark may include comparisons in your content, but every factual claim within a comparison must be source-verifiable; hallucinated comparative facts will be rejected.

Repeated requests to publish prohibited comparative content (named competitors at any tier, or any comparison at all if regulated) against this policy are grounds for account termination.

1. Prohibited Uses (Universal)

Illegal Activity

You may not use Toutmark for any illegal purpose or in violation of any federal, state, local, or international law.

Platform Integrity

You may not:

Harassment & Threats

You may not use Toutmark to send spam, harass, defame, threaten, or discriminate against any person or organization.

Malware & Harmful Code

You may not distribute malware, trojans, viruses, worms, ransomware, or other malicious code through Toutmark.

Intellectual Property Infringement

You may not use Toutmark to infringe upon anyone's copyrights, trademarks, patents, or trade secrets.

Credential Sharing

You may not share your account login credentials with unauthorized third parties.

2. Prohibited Content Categories for Content Rewriting

You agree not to use Toutmark to rewrite, optimize, or generate content in the following categories:

Gambling (Outside Regulated Jurisdictions)

Content promoting or facilitating gambling outside of regulated jurisdictions (e.g., unlicensed gambling operations).

Firearms

Content facilitating the sale of firearms to prohibited persons (e.g., those with felony convictions, minors).

Controlled Substances

Content promoting the sale of cannabis, CBD, or other controlled substances outside of states or jurisdictions where they are legally permitted.

Adult Content

Sexually explicit content, pornography, or adult services.

Content Involving Minors

Any content that sexualizes, exploits, harms, or endangers children.

Regulated Professional Advice

Content posing as medical advice, legal advice, or financial advice when written by someone without appropriate credentials. (You may use Toutmark to write educational content, but you may not present it as professional counsel.)

3. Prohibited Integration Behaviors

Unauthorized Site Modification

You may not use Toutmark to rewrite or modify content on websites you do not own or manage, or that you do not have express written permission to edit. This includes:

Review Platform Spam

You may not use Toutmark to spam review platforms (G2, Capterra, etc.) with fake reviews or artificially inflated ratings.

4. Enforcement & Consequences

Violations of this Acceptable Use Policy are handled as follows:
